MANILA – Labag sa Saligang Batas ang kasunduan sa pagitan ng Department of National Defense at University of the Philippines (DND-UP), ayon kay Armed Forces of the Philippines chief-of-staff Gen. Gilbert Gapay.
Sa isang pahayag, sinabi ni Gapay na ang prebilehiyong ibinigay sa UP sa ilalim ng ibinasurang kasunduan ay paglabag sa tinatawag na “equal protection clause” sa ilalim ng 1987 Constitution.
“There is no substantial distinction between UP and other schools, state colleges, and universities. To give to UP such entitlement places it an unfairly advantaged status over the academic institutions and defies that Constitutional guarantee of equality of rights and protections under our laws,” ani Gapay.
Nagpahayag din ng suporta si Gapay sa hakbang ng DND na ibasura ang nasabing kasunduang pinirmahan noong 1989 sa pasasabing ito’y hindi patas para sa taumbayan at taliwas sa interes ng publiko.
“Thus, the termination of the said accord does not violate the Constitution or any substantive laws of the land. On the contrary, the termination rectifies what we believe was in fact infringement of our Constitution,” ani Gapay.
Idinagdag pa ni Gapay na panahon na upang tapusin ang kasunduan na ginagamit ng Communist Party of the Philippines-New People’s Army (CPP-NPA sa kanilang recruitment.
Sinabi rin ni Gapay na ang unibersidad ay isa sa pinakamalaking pinagkukunan ng tauhan ng NPA. (AI/FC/MTVN)
