Leni Robredo on April 11, 2022 posted on Twitter, “Tuloy-tuloy ang coordination natin with LGUs regarding #AgatonPH para makapagdala na agad ng tulong sa mga apektadong lugar ng TY Agaton.”
Is Leni Robredo supposed to take credit for the relief efforts for tropical depression-hit areas 28 days before the elections?
Rating: A CLEAR CUT VIOLATION OF THE OMNIBUS ELECTION CODE and an EXPLICIT DISPLAY OF VOTE BUYING 28 DAYS BEFORE THE NATIONAL ELECTION DAY.
In times of disasters, we need to send aid. But, to take advantage of the situation in order to buy support to favor one’s candidacy during the campaign period is a clear-cut violation and disrespect of the Omnibus Election Code of the Philippines.
On April 11, 2022, Leni Robredo on Twitter, posted a sequence of posts that indirectly displays her effort to obtain votes through relief goods:
“We have been coordinating with volunteers since yesterday. Maraming salamat po sa ating mga volunteers na handang tumugon sa pangangailangan ng ating mga kababayan.”
“Sa Baybay, Leyte, parating na ang tulong na drinking water by lunchtime. Sa Abuyog, Leyte at Sogod, Southern Leyte naman, target ng ating volunteers to distribute relief packs by this afternoon.”
“Tuloy-tuloy ang coordination natin with LGUs regarding #AgatonPH para makapagdala na agad ng tulong sa mga apektadong lugar ng TY Agaton.”
THIS IS AN EXPLICIT DISPLAY OF VOTE BUYING 28 DAYS BEFORE THE NATIONAL ELECTION DAY.
Here are the provisions of the Omnibus Election Code Leni Robredo has violated:
“Omnibus Election Code – Article XXII Sec. 261. Prohibited Acts. – The following shall be guilty of an election offense:
a. Vote-buying and vote-selling. Any person who gives, offers or promises money or ANYTHING OF VALUE, gives or promises any office or employment, franchise or grant, public or private, or makes or offers to make an expenditure, directly or indirectly, or cause expenditure to be made to any person, association, corporation, entity, or community in order to induce anyone or the public, in general, to vote for or against any candidate or withhold his vote in the election, or to vote for or against any aspirant for the nomination or choice of a candidate in a convention or similar selection process of a political party.
j. Undue influence. – It is unlawful for any person to promise any office or employment, public or private, or TO MAKE OR OFFER TO MAKE AN EXPENDITURE, DIRECTLY OR INDIRECTLY, or to cause expenditure to be made to any person, association, corporation, or entity, WHICH MAY INDUCE ANYONE OR THE PUBLIC IN GENERAL EITHER TO VOTE OR WITHHOLD HIS VOTE, or vote for or against any candidate in any election or any aspirant for the nomination or selection of an official candidate in a convention of a political party. It is likewise unlawful for any person, association, corporation or community, to solicit or receive, directly or indirectly, any expenditure or promise or any office, or employment, public or private, for any of the foregoing considerations.”
What Leni Robredo cannot legally do directly, she cannot do indirectly. Her relief exhibitions 28 days before the elections qualify HER FOR DISQUALIFICATION.
OMNIBUS ELECTION CODE OF THE PHILIPPINES:
Leni Robredo’s OMNIBUS ELECTION CODE OF THE PHILIPPINES violation in taking credit for the OVP’s relief efforts 28 days before the election.
Reports from different news companies that OVP and NOT Leni has some exemptions during the 2022 elections:
What cannot be legally done directly cannot be done indirectly.
