Bantag lawyer slams erroneous subpoena

MANILA — Whoever drafted the subpoena for suspended Bureau of Corrections (BuCor) Gerald Bantag made a “fatal error” writing the embattled prison chief’s middle name, and a good excuse too, for him not to appear in the preliminary and second investigations.

This is what Bantag’s lawyer Rocky Balisong pointed out on Wednesday’s preliminary investigation saying the subpoena requiring his client to attend the November 23 and December 5 preliminary investigations was intended for a “different” person.

“He [Gerald Bantag y Soriano] is different from DG Gerald Bantag y Quitaleg. So, [these are] two different individuals,” Balisong said when interviewed on Wednesday, November 23.

He stressed that the error “is fatal.”

Bantag’s co-respondent, BuCor Deputy Security Officer (DSO) Ricardo Zulueta was conspicuously absent during the preliminary probe.

On Tuesday, November 22, Justice Secretary Jesus Crispin “Boying” Remulla said he heard rumors that Zulueta might be dead already but could not just believe them.

“I haven’t had a briefing about it. There was up north rumors; there are still rumors. We are still presuming he is alive and we will look for him,” Remulla said.

Bantag is being tagged as the mastermind in the Oct. 3 killing of hard-hitting radio commentator Percy Lapid. (ai/mtvn)
