Las Pinas RTC dismisses drug case against SOJ Remulla’s son

MANILA — The Las Pinas Regional Trial Court (RTC) Branch 197 dismissed the drug case on Friday (06 January 2023) filed against the son of Justice Secretary Crispin “Boying” Remulla, Juanito Jose Remulla III, after he was caught with P1.3 million kush or hybrid marijuana.

Las Pinas RTC Branch 197 Judge Ricardo Moldez II acquitted Remulla due to insufficient evidence.

“Unfortunately, apart from showing that the package or parcel was handed to the accused, the prosecution did not present other evidence to show that the former knew that it contained marijuana. The prosecution failed to show that [the] accused, by receiving the parcel, knew that he was also possessing illegal drugs,” the 34-page decision read.

“The prosecution failed to establish during the ‘detection stage’ or before the parcel allegedly containing the illegal drugs was turned over to the PDEA that precautions were taken to ensure that there had been no change in the condition of the parcel and its contents and that there was no opportunity for someone not in the chain to have possession of the same during the same period,” the court further explained.

“Because of this, this Court is unable [to] to discount the possibility of evidence tampering on that occasion,” it added.

Atty. Perlito Campanilla, the lead counsel of Remulla explained the reason why his client was acquitted.

“Mali ang pangalan sa shipper’s from at yung kanyang ID, kung kayo po ay may parcel at usually hinihingan kayo ng dalawang ID, kapag mali ang spelling niyan, hindi ibibigay. Ang nangyari po dito, isang ID lang ang hiningi sa kanya mali pa nga,” Campanilla said.
