MANILA — Elenita Binay has been acquitted of graft and malversation charges by the Fourth Division of the Sandiganbayan in Manila, Philippines.
The charges were related to the alleged absence of public bidding in the 2001 purchase of hospital equipment worth P9.9 million for the Ospital ng Makati.
The court, in its decision on Monday authored by Ma. Reina Leanne Tolentino emphasized that the prosecution failed to establish Binay’s guilt beyond a reasonable doubt.
Conversely, Conrado Pamintuan and Jaime de los Reyes, Binay’s co-accused, were convicted of graft.
Pamintuan, the former supply officer of the city, and de los Reyes, the former administrative officer, received sentences of six years and a month to eight years, coupled with perpetual disqualification from public service.
